Yeminli Mali M\u00fc\u015favir inceledi ve DEKA\u015e\u2019\u0131n bu s\u00f6zle\u015fme nedeniyle u\u011frad\u0131\u011f\u0131 toplam zarar\u0131 ortaya koydu. Ge\u00e7en seneki bilan\u00e7oda bizim fiili zarar\u0131m\u0131z 2,6 trilyon, ama buna r\u00f6mork\u00f6rlerin sat\u0131\u015f\u0131ndan u\u011fran\u0131lan zarar\u0131 ekledi\u011fimizde 6 trilyonu buluyor. Daha sonra s\u00f6zle\u015fmeyi hukuksal y\u00f6nden incelettik tamamen tek tarafl\u0131, DEKA\u015e\u2019\u0131n aleyhine oldu\u011fu s\u00f6ylendi. Onun \u00fczerine Marin R\u00f6mork\u00f6r\u2019e dava a\u00e7t\u0131k, ancak s\u00f6zle\u015fmeyi imzalayan DEKA\u015e y\u00f6neticileri de davan\u0131n i\u00e7inde yer ald\u0131.<\/p><p><strong><em>\u2013 DEKA\u015e daha \u00f6nce de r\u00f6morkaj geliri alm\u0131yordu ki, b\u00f6yle bir zarar nas\u0131l olu\u015fabilir?<\/em><\/strong><\/p><p>\u0130zin hakk\u0131 olan DEKA\u015e Marin R\u00f6morkaj\u2019a \u2018Sen gel benim bu b\u00f6lgede ta\u015feronlu\u011fumu yap\u2019 diyor. Deka\u015f ve Med-Marin olarak biz bu i\u015fin ayn\u0131s\u0131n\u0131 Tuzla\u2019da G\u0130SA\u015e\u2019n\u0131n ta\u015feronlu\u011funu yaparak uygulad\u0131k. \u0130zin hakk\u0131 G\u0130SA\u015e\u2019\u0131nd\u0131 ama ekipman ve personeli yoktu. \u0130zin hakk\u0131 G\u0130SA\u015e\u2019a ait oldu\u011fu i\u00e7in devlete \u00f6denen %6,5 pay d\u00fc\u015f\u00fcr\u00fcld\u00fckten sonra, kalan gelirin %25\u2019ini G\u0130SA\u015e\u2019a pay olarak verdik. Ama DEKA\u015e ile Marin-R\u00f6morkaj aras\u0131ndaki s\u00f6zle\u015fmeye bakt\u0131\u011f\u0131n\u0131zda Marin R\u00f6morkaj faturan\u0131n t\u00fcm\u00fcn\u00fc al\u0131yor; ayr\u0131ca devlete \u00f6denen %6,5 pay\u0131n t\u00fcm\u00fcn\u00fc de DEKA\u015e \u00f6d\u00fcyor. Bizim G\u0130SA\u015e\u2019a \u00f6dedi\u011fimiz pay gibi hi\u00e7bir \u00f6deme yapmazken bir de vergisini DEKA\u015e\u2019a \u00f6detiyor. Bunun d\u0131\u015f\u0131nda; acentelere; k\u0131lavuzlukta b\u00fcy\u00fck, r\u00f6morkajda d\u00fc\u015f\u00fck bir tak\u0131m indirimler yap\u0131l\u0131yor. R\u00f6morkaj indirimleri %15 civar\u0131nda ve bu indirimin %5\u2019ini de DEKA\u015e \u00f6d\u00fcyor.<br \/><em><strong>\u2013 B\u00f6yle bir anla\u015fma Med Marine\u2019nin k\u0131lavuzlu\u011fa ba\u015flamas\u0131yla DEKA\u015e\u2019\u0131n \u00e7ok zor durumda kald\u0131\u011f\u0131n\u0131 m\u0131 g\u00f6steriyor?<\/strong><\/em><\/p><p>O zaman (ki y\u00f6neticiler kendi yapt\u0131klar\u0131 hata sonucunda) s\u0131k\u0131\u015ft\u0131klar\u0131ndan dolay\u0131 \u2018denize d\u00fc\u015fen y\u0131lana sar\u0131l\u0131r\u2019 misali Marin R\u00f6morkaj ile b\u00f6yle bir anla\u015fma yap\u0131ld\u0131. DEKA\u015e yaln\u0131z k\u0131lavuzluk yapamayaca\u011f\u0131ndan, r\u00f6morkaja ba\u015flamas\u0131 gerekiyordu. Zaten bizim arkada\u015flar bunun pl\u00e2n\u0131n\u0131 evvelden yapm\u0131\u015flar ki, bir tane r\u00f6mork\u00f6r al\u0131nm\u0131\u015f ve be\u015f tane de r\u00f6mork\u00f6r te\u015fviki alm\u0131\u015flar ve ikisini de in\u015fa ettirmeye ba\u015flam\u0131\u015flard\u0131. Kendileri bu i\u015fi yapamad\u0131klar\u0131 i\u00e7in (de) acente ve armat\u00f6rlerin 1998\u2019de kurmu\u015f oldu\u011fu Marin R\u00f6mork\u00f6r ve K\u0131lavuzluk A\u015e ile bir s\u00f6zle\u015fme imzalad\u0131lar. Bana g\u00f6re r\u00f6mork\u00f6r bulunabilirdi veya kiralanabilirdi, bu yap\u0131lmad\u0131\u011f\u0131 gibi DEKA\u015e\u2019\u0131n elindeki \u00fc\u00e7 r\u00f6mork\u00f6r de maliyetlerinin alt\u0131na 96 ay vadeyle, 16.666 dolar ayl\u0131k taksitlerle Marin firmas\u0131na sat\u0131ld\u0131. \u00d6yle bir r\u00f6mork\u00f6r\u00fc kiraya verseniz 40.000 dolar getirirdi oysa\u2026! M\u00fcste\u015farl\u0131k bu i\u015fe nas\u0131l izin verdi diye d\u00fc\u015f\u00fcn\u00fclebilir. Y\u00f6netime geldi\u011finiz zaman DEKA\u015e ve Marin aras\u0131nda imzalanm\u0131\u015f iki tane s\u00f6zle\u015fme oldu\u011funu g\u00f6rd\u00fck. Biri 10 Mart 2004, di\u011feri 14 Mart 2004 tarihli yap\u0131lm\u0131\u015f. \u0130lk s\u00f6zle\u015fme k\u0131sa ve yal\u0131n, r\u00f6mork\u00f6r sat\u0131\u015f\u0131 ile ilgili hi\u00e7bir h\u00fck\u00fcm yok ve o s\u00f6zle\u015fme Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131\u2019na g\u00f6nderilip izin al\u0131nm\u0131\u015f. Anla\u015f\u0131lan \u015fu ki DEKA\u015e, bu i\u015fi sanki kendi r\u00f6mork\u00f6rleriyle yapt\u0131r\u0131yormu\u015f gibi sunmu\u015f ve d\u00f6rt g\u00fcn sonra da yap\u0131lan s\u00f6zle\u015fme ile sat\u0131\u015f i\u015flemleri ortaya koyulmu\u015f.<\/p><p><strong><em>-M\u00fcste\u015farl\u0131k izinleri ayr\u0131 ayr\u0131 vermemi\u015f miydi? Sizden sonra ki y\u00f6netim neden Med-Marin ile \u00e7at\u0131\u015fma haline girdi?<\/em><\/strong><\/p><p>DEKA\u015e-Med Marine konsorsiyumu olarak 1996\u2019da Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 taraf\u0131ndan \u0130zmit ve \u0130skenderun k\u00f6rfezinde k\u0131lavuzluk ve r\u00f6morkaj hizmet yetkisi ald\u0131k. 1998\u2019de K\u0131lavuzluk ve R\u00f6morkaj hakk\u0131nda ki \u2018Te\u015fkilat Y\u00f6netmeli\u011fi\u2019 \u00e7\u0131k\u0131nca izinler yeniden \u015fekillendi ve 20 y\u0131l izin verildi. Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 izni m\u00fc\u015fterek te\u015febb\u00fcse verdi. K\u0131lavuzlu\u011fu \u015fu firma, r\u00f6morkaj\u0131 \u015fu firma yapar diye ayr\u0131 ayr\u0131 vermedi. Verilen izin ortak oldu\u011fu i\u00e7in her iki \u015firketin de her iki hizmeti verme hakk\u0131 do\u011fdu\u011fundan, Med-Marine ile masaya oturduk. Her iki hizmeti de verirsek karga\u015fa ve kaynak israf\u0131 olur, hizmet ayr\u0131m\u0131 yapal\u0131m dedik ve b\u00f6ylelikle k\u0131lavuzlu\u011fu biz vermeye ba\u015flad\u0131k. \u0130znin ortak olmas\u0131ndan dolay\u0131, her iki \u015firket de K\u00f6rfez\u2019in t\u00fcm gelirlerine ortak oldu\u011fu i\u00e7in k\u00e2r\u0131 veya br\u00fct geliri payla\u015fmam\u0131z gerekiyordu. Br\u00fct geliri b\u00f6l\u00fc\u015fmeye karara verdik. \u00d6rne\u011fin o zaman ki verilere g\u00f6re k\u0131lavuzluk 10 birim getiriyorsa r\u00f6morkaj 3 birim getiriyordu. (Toplam gelir olan)13\u2019\u00fc yar\u0131ya b\u00f6ld\u00fc\u011f\u00fcn\u00fcz de \u015firketlere br\u00fct 6,5 kal\u0131yor. K\u0131lavuzluk hizmetlerinin 3,5\u2019ini, 3 birim getiren r\u00f6morkaj firmas\u0131na eklemeniz gerekiyordu, onu yaparak aram\u0131zda s\u00f6zle\u015fme imzalad\u0131k. 1999\u2019da ayr\u0131ld\u0131m. Sonraki y\u00f6netim Med-Marine ile \u00e7at\u0131\u015fma haline girdi. 1 A\u011fustos 2003 tarihinde Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 Liman hizmetleri tarifelerini y\u00fcr\u00fcrl\u00fc\u011fe koydu. \u2018Hizmeti veren faturay\u0131 tam keser\u2019 maddesini \u00f6ne s\u00fcrerek, Med-Marine ile kavga halinde olan y\u00f6netim, Med-Marin\u2019e faturay\u0131 tam keseriz, sana da 35\u2019i vermeyiz demi\u015fler. Bana g\u00f6re yanl\u0131\u015f yapt\u0131lar, \u00e7\u00fcnk\u00fc izin ortak (ve iki \u015firket aras\u0131ndaki gelir e\u015fitli\u011finin Tarifeyle bir ilgisi yok), bu \u00e7\u00f6z\u00fclemeyince Med-Marine firmas\u0131 da k\u0131lavuzluk hizmeti vermeye karar verdi.<br \/><em><strong>-Sizin y\u00f6netime gelmenizle eski sisteme d\u00f6n\u00fc\u015f oldu mu? B\u00f6lgede hala iki k\u0131lavuzluk \u015firketinin hizmet verdi\u011fi s\u00f6yleniyor ve bu sizin \u015fimdiye kadar savundu\u011funuz sisteme ters d\u00fc\u015fm\u00fcyor mu?<\/strong><\/em><\/p><p>Eski sisteme tam d\u00f6n\u00fclemedi. \u00c7\u00fcnk\u00fc eski sistemde b\u00fcy\u00fck geliri k\u0131lavuzluk hizmetleri sa\u011fl\u0131yordu. M\u00fcste\u015farl\u0131k \u2018herkes kendi yapt\u0131\u011f\u0131 i\u015fin faturas\u0131n\u0131 keser\u2019 dedi\u011fi ve Med-Marine de iki sene i\u00e7inde k\u0131lavuzluk i\u015fi yapmaya ba\u015flad\u0131\u011f\u0131 i\u00e7in eskiye d\u00f6n\u00fc\u015f olmad\u0131. \u0130zin ortakt\u0131r, gelir e\u015fit payla\u015f\u0131lmal\u0131d\u0131r. Yani biz de k\u0131lavuzluk hizmeti veriyoruz, Med-Marine de veriyor. Gelirlerin e\u015fitlenmesi i\u00e7in uygulama yap\u0131l\u0131yor. \u015eu anda DEKA\u015e\u2019\u0131n elinde r\u00f6mork\u00f6r olmad\u0131\u011f\u0131 i\u00e7in bu hizmeti Med-Marin\u2019den al\u0131p sanki bizim ta\u015feromuzmu\u015f gibi pay al\u0131yoruz. Asl\u0131nda olmamas\u0131 gerek bir \u015fey ama iki sene i\u00e7inde bozulan dengeler y\u00fcz\u00fcnden b\u00f6yle bir \u015fey ortaya \u00e7\u0131kt\u0131.<br \/><strong><em>-Sizin uzla\u015fman\u0131zdan DTO mu, yoksa Marine R\u00f6mork\u00f6r\u2019\u00fcn ortaklar\u0131 m\u0131 rahats\u0131z ve neden \u0130zmit K\u00f6rfezi?<\/em><\/strong><\/p><p>Marin R\u00f6morkaj 1998\u2019den beri u\u011fra\u015f\u0131yor. Marin R\u00f6mork\u00f6r ve K\u0131lavuzluk A\u015e T\u00fcrk karasular\u0131nda k\u0131lavuzluk ve r\u00f6morkaj i\u00e7in M\u00fcste\u015farl\u0131k\u2019dan izin istedi, alamad\u0131 dava a\u00e7t\u0131 kaybetti, Dan\u0131\u015ftay\u2019da a\u00e7t\u0131 yine kaybetti. Rekabet kurumuna \u015fik\u00e2yet etti yine Dan\u0131\u015ftay\u2019\u0131n kararlar\u0131na benzer a\u00e7\u0131klamalarla kar\u015f\u0131la\u015ft\u0131. T\u00fcrkiye\u2019deki k\u0131lavuzluk ve r\u00f6morkaj hizmetlerinin cirosunun 100 milyon dolar civar\u0131nda oldu\u011fu s\u00f6yleniyor. Bunun %50\u2019si \u0130stanbul ve \u00c7anakkale bo\u011fazlar\u0131na ait. Geriye kalan gelir ise di\u011fer b\u00f6lgelere kal\u0131yor ve en b\u00fcy\u00fck pay \u0130zmit K\u00f6rfezinde bulunuyor ve \u0130stanbul\u2019a da yak\u0131n, onun i\u00e7in herkes g\u00f6z\u00fcn\u00fc dikmi\u015f durumda. D\u00fcnyan\u0131n baz\u0131 b\u00f6lgelerinde birden fazla r\u00f6mork\u00f6r \u015firketinin hizmet verdi\u011fi do\u011fru. Ama bunlar Rotterdam, Anwerp, Hamburg gibi b\u00fcy\u00fck limanlar ve firmalar aras\u0131nda rekabet yok. Havuz olu\u015fturmu\u015flar s\u0131ra ile yap\u0131yorlar. Ama o limanlara gelen gemi say\u0131s\u0131 ve tonajlar\u0131na bakt\u0131\u011f\u0131m\u0131z zaman T\u00fcrkiye\u2019de b\u00f6yle bir liman\u0131n ve pastan\u0131n olmad\u0131\u011f\u0131n\u0131 g\u00f6r\u00fcyoruz.<br \/><em><strong>-Uzla\u015fman\u0131n tekrar sa\u011flanmas\u0131yla k\u00f6rfezde \u2018monopol\u2019 olu\u015ftu\u011fu iddia ediliyor?<\/strong><\/em><\/p><p>Monopol olundu diyorlar ama tekel olmak i\u00e7in iki \u015fart gerekli. Tek olacaks\u0131n\u0131z ve fiyatlar\u0131 da siz belirleyeceksiniz. Bizim uygulad\u0131\u011f\u0131m\u0131z tarifeleri Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 belirliyor. Arpa\u015f ve Uzmar gibi di\u011fer firmalar\u0131n uygulad\u0131\u011f\u0131 gibi. Asl\u0131na bak\u0131l\u0131rsa TCDD ve TD\u0130 tekel, hem tekler hem de kendi tarifelerini uyguluyorlar. Fiyatlar\u0131n d\u00fc\u015fmesi rekabeti artt\u0131r\u0131r diye iddia ediyorlar ama buradaki uygulama batk\u0131m\u0131z zaman \u015funu g\u00f6r\u00fcyoruz; Acente geliyor diyor ki, faturay\u0131 bana tam kes ya da %20 indirimi g\u00f6ster ama %30 \u2018unu da iade faturas\u0131 ile bana iade et. Bu yolla bizim bilan\u00e7olar\u0131m\u0131zda g\u00f6z\u00fcken 2,7 trilyon 300 milyar da a\u00e7\u0131ktan verilmi\u015f, toplam 3 trilyon acentelere komisyon olarak \u00f6dendi. \u0130zmit K\u00f6rfezi\u2019ne gelen gemilerin %80\u2019i yabanc\u0131 armat\u00f6re ait oysa.<br \/><strong><em>-Art\u0131k sizin r\u00f6morkaj verme imkan\u0131n\u0131z da yok. DEKA\u015e y\u00f6netimin de\u011fi\u015fmesi halinde ya anla\u015fmazl\u0131klar yeniden ba\u015flarsa ne olacak?<\/em><\/strong><\/p><p>Bu i\u015f art\u0131k firmalara b\u0131rakmamal\u0131 Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 mevzuatlarla d\u00fczenlemeli. Bundan \u00f6nce ya\u015fad\u0131\u011f\u0131m\u0131z olaylar\u0131n burada tekrar ya\u015fanmamas\u0131 laz\u0131m; \u00e7\u00fcnk\u00fc b\u00fct\u00fcn d\u00fcnyaya ayk\u0131r\u0131 ve ters \u015feyler ya\u015fad\u0131k. Bunu \u015firketlere b\u0131rak\u0131rsan\u0131z y\u00f6netimler farkl\u0131 karar al\u0131rsa d\u00fcnyadaki uygulamalara ters d\u00fc\u015f\u00fcyorsunuz. Te\u015fkilat y\u00f6netmeli\u011fi 1996\u2019da \u00e7\u0131kar\u0131labilseydi TD\u0130\u2019de izin verme yar\u0131\u015f\u0131n\u0131n i\u00e7inde olabilirdi. Ancak TD\u0130\u2019nin hizmet verdi\u011fi y\u0131llarda gerekli personel yan\u0131nda, r\u00f6mork\u00f6r, pilot motoru gibi ara\u00e7 eksiklerinden dolay\u0131 gemilere gere\u011fince hizmet verilemiyordu. T\u00fcrkiye bekleyen gemilere y\u0131lda milyonlarca dolar demoraj \u00fccreti \u00f6d\u00fcyordu. 1997 y\u0131l\u0131nda TDi k\u00f6rfezden \u00e7ekilmemi\u015f olsayd\u0131 1998 y\u0131l\u0131nda \u00e7\u0131kan \u2018Te\u015fkilat y\u00f6netmeli\u011fi\u2019 uyar\u0131nca M\u00fcste\u015farl\u0131k sadece bir kuruma izin vermek zorundayd\u0131 ve TD\u0130\u2019nin \u015fans\u0131 yoktu. Ayr\u0131ca bedava da verilmedi. M\u00fcste\u015farl\u0131k her ay cironun %6,5\u2032 ini al\u0131yor.<br \/><em><strong>-T\u00fcrkiye\u2019de neden AB veya D\u00fcnya \u00dclkelerinde uygulanan bir sistem kurulamad\u0131 ya da kurulabilir mi?<\/strong><\/em><\/p><p>T\u00fcrkiye Denizcilik \u0130\u015fletmeleri\u2019nin b\u00fct\u00fcn birimleri \u00f6zelle\u015ftirme kapsam\u0131na al\u0131n\u0131nca k\u0131lavuzluk hizmetlerinin de \u00f6zelle\u015fece\u011fini g\u00f6rd\u00fck. AB \u00fclkelerinde bu i\u015fler k\u0131lavuz kaptanlar\u0131n kurdu\u011fu birlikler ve kurulu\u015flara verilmi\u015f ve tarifeleri devlet belirliyor. DEKA\u015e\u2019\u0131 kurma amac\u0131m\u0131z da buydu. Ayn\u0131 yap\u0131y\u0131 T\u00fcrkiye\u2019de kurmak i\u00e7in \u00d6zelle\u015ftirme \u0130daresi ve Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131\u2019na m\u00fcracaat ederek Avrupa\u2019n\u0131n bir\u00e7ok \u00fclkesinin k\u0131lavuzluk kanunu getirip sunduk, ancak \u00e7e\u015fitli nedenlerden dolay\u0131 yap\u0131lamad\u0131. T\u00fcrkiye\u2019de Avrupa \u00fclkelerine benzer bir kanun \u00e7\u0131karmak art\u0131k zorla\u015ft\u0131. \u00d6zelle\u015ftirilen limanlar bu hizmetleri de ald\u0131, kamu kurulu\u015flar\u0131 kendi veriyor ve bizim gibi kurulu\u015flar da veriyor. Nas\u0131l \u00e7\u00f6z\u00fclebilir bilemiyorum. Ancak k\u0131lavuzlar\u0131n patronu olmamal\u0131, k\u0131lavuz armat\u00f6r\u00fcn veya liman\u0131n adam\u0131 olmamal\u0131; mesle\u011fin ruhuna ayk\u0131r\u0131. Ba\u011f\u0131ms\u0131z karar verebilmeli, \u00e7\u00fcnk\u00fc baz\u0131 durumlarda liman ve armat\u00f6r ile kamu \u00e7\u0131karlar\u0131 ters d\u00fc\u015febiliyor.
