Buna g\u00f6re:<br \/>a) \u0130dare: Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131\u2019n\u0131,<br \/>\u00e7) K\u0131lavuz kaptan: Bu y\u00f6netmelikte belirtilen k\u0131lavuz kaptan yeterlik belgelerinden birisine sahip olarak, yetkili k\u0131lavuz kaptan belgesinde yetkilendirildi\u011fi belirtilmi\u015f, ilgili mevzuat gere\u011fi gemide k\u0131lavuz kaptan bulundurman\u0131n mecburi veya ihtiyari oldu\u011fu alanlar dahilinde gemi kaptan\u0131na uluslararas\u0131 denizcilik team\u00fcllerine g\u00f6re geminin seyir ve manevras\u0131na y\u00f6nelik konularda dan\u0131\u015fmanl\u0131k yapan ve gemi kaptan\u0131n\u0131n sorumlulu\u011fu alt\u0131nda gemiye manevra ve seyir ile s\u0131n\u0131rl\u0131 k\u0131lavuzluk hizmeti veren ki\u015fiyi,<br \/>d) K\u0131lavuzluk te\u015fkilat\u0131: Yetki ve faaliyet alan\u0131 ve hizmet b\u00f6lgesi s\u0131n\u0131rlar\u0131 \u0130dare taraf\u0131ndan belirlenmi\u015f olan ve bu hizmet b\u00f6lgesinde kendisine \u0130dare taraf\u0131ndan k\u0131lavuzluk veya k\u0131lavuzluk ve r\u00f6mork\u00f6rc\u00fcl\u00fck hizmetleri yapma izni verilen kamu veya \u00f6zel te\u015febb\u00fcse ait t\u00fczel ki\u015filikleri ve ortak giri\u015fimleri,<br \/>e) K\u0131lavuzluk istasyonu: K\u0131lavuzluk hizmet b\u00f6lgesi i\u00e7erisinde hizmet vermek \u00fczere; yetkili k\u0131lavuzluk veya k\u0131lavuzluk ve r\u00f6mork\u00f6rc\u00fcl\u00fck te\u015fkilat\u0131 taraf\u0131ndan kurulan, k\u0131lavuz kaptan alma-verme mevkilerine uygun mesafede konumlanm\u0131\u015f, \u0130dare taraf\u0131ndan belirlenen nitelik ve say\u0131da ara\u00e7, gere\u00e7 ve teknik donan\u0131ma haiz ve istihdam edilen k\u0131lavuz kaptanlar\u0131n vardiya d\u00fczenine uygun bar\u0131nma ve ya\u015fama gereksinimlerinin de sa\u011fland\u0131\u011f\u0131 hizmet birimlerini,<\/p><p>\u015feklinde d\u00fczenlenmesi uygun olacakt\u0131r.<\/p><p>NOT: Taslak Y\u00f6netmeli\u011fin bir\u00e7ok maddesinde, \u00f6rne\u011fin 1\u2019inci, 2\u2019inci, 3\u2019\u00fcnc\u00fc, 4\u2019\u00fcnc\u00fc maddelerde, v.b., (1) \u015feklinde bent g\u00f6sterilmi\u015f ancak (2)\u2019inci bent bulunmuyor. Dolay\u0131s\u0131yla devam\u0131 olmayan (1) \u015feklindeki bent numaralar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 gerekiyor.<\/p><p><br \/><strong>* Madde 7\u2019nin (1) bendinin \u015fu \u015fekilde de\u011fi\u015fmesi uygun olacakt\u0131r:<\/strong>\u00a0\u201cBu y\u00f6netmeli\u011fin 6 nc\u0131 maddesinin (a), (b), (c), (\u00e7), (d) ve (f) bentlerindeki ko\u015fullar\u0131 sa\u011flayan k\u0131lavuz kaptan aday\u0131 bunlara, yetkili k\u0131lavuzluk te\u015fkilat\u0131nca stajyer k\u0131lavuz kaptan olarak istihdam edildi\u011fini g\u00f6sterir belgeyi de ekleyerek, bir dilek\u00e7e ile ilgili liman ba\u015fkanl\u0131\u011f\u0131na ba\u015fvurur.\u201d<\/p><p><strong>De\u011fi\u015fiklik Gerek\u00e7esi:<\/strong>\u00a0B\u00fct\u00fcn d\u00fcnyada, kendisine yetki verilmi\u015f her k\u0131lavuzluk te\u015fkilat\u0131, hizmet verdi\u011fi b\u00f6lgedeki trafik hacmine g\u00f6re, yeterli say\u0131da k\u0131lavuz kaptan\u0131 istihdam edebilmek i\u00e7in (ki bunu, yetkili devlet idaresi de te\u015fkilattan isteyebilir), gerekli oldu\u011funda, gerekli say\u0131da ki\u015fiye e\u011fitim verip staj yapt\u0131r\u0131r. Bunun d\u0131\u015f\u0131nda, i\u015fe al\u0131p \u00e7al\u0131\u015ft\u0131rmayaca\u011f\u0131 halde, k\u0131lavuzluk te\u015fkilat\u0131n\u0131n her isteyene ya da liman ba\u015fkanl\u0131\u011f\u0131na her ba\u015fvurana, e\u011fitim vermesi, staj yapt\u0131rmas\u0131, s\u00f6z konusu de\u011fildir.<\/p><p>\u00d6rne\u011fin Alman K\u0131lavuzluk Kanunu\u2019nda bu konuyu d\u00fczenleyen \u201cStajyer K\u0131lavuz Kaptanlar\u0131n Ba\u015fvurusu Ve \u0130\u015fe Al\u0131nmas\u0131\u201d ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 8\u2019inci maddede: \u201cTrafik hacmi ve mevcut hizmet g\u00fcc\u00fcn\u00fc dikkate alarak, \u0130dare\u2019nin, K\u0131lavuzluk Te\u015fkilat\u0131na dan\u0131\u015farak, her sene bir defa, gereken say\u0131da stajyer k\u0131lavuz kaptan al\u0131nmas\u0131na karar verece\u011fi, fazla ba\u015fvuru olmas\u0131 durumunda staja kabul edilmeyen ba\u015fvuru sahiplerinin sonraki y\u0131l yeniden ba\u015fvurabilecekleri\u201d belirtilmektedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi, \u201cihtiya\u00e7 fazlas\u0131 olanlara\u201d ve \u201cher ba\u015fvurana\u201d e\u011fitim verilmesi ve staj yapt\u0131r\u0131lmas\u0131 s\u00f6z konusu de\u011fildir.<\/p><p>Ayr\u0131ca, yine b\u00fct\u00fcn d\u00fcnyada, k\u0131lavuzluk hizmetlerinde, her ba\u015fvurana e\u011fitim yapt\u0131r\u0131l\u0131p, staj yapt\u0131r\u0131lmad\u0131\u011f\u0131 gibi, \u201cba\u015fvuranlara, ba\u015fvuru s\u0131ras\u0131yla, se\u00e7me yap\u0131lmaks\u0131z\u0131n\u201d e\u011fitim ve staj da yapt\u0131r\u0131lmamaktad\u0131r. Bu konuda, K\u0131lavuzluk Te\u015fkilat\u0131na: Ba\u015fvuranlar aras\u0131ndan, \u201ce\u011fitim yapt\u0131racaklar\u0131n\u0131, staj yapt\u0131racaklar\u0131n\u0131 se\u00e7me hakk\u0131\u201d tan\u0131nmaktad\u0131r.<br \/>Yine \u00f6rne\u011fin, Alman K\u0131lavuzluk Kanunu\u2019nun \u201cStajyer K\u0131lavuz Kaptanlar\u0131n Kabul Edilmesi \u0130\u00e7in Gerekli \u015eartlar\u201d ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 9\u2019uncu maddesinde s\u0131ralanan ko\u015fullar\u0131n 4\u2019\u00fcnc\u00fc bendinde yer alan: \u201cYa\u015fama tarz\u0131yla k\u0131lavuz kaptanl\u0131k mesle\u011finin gerektirdi\u011fi, do\u011fu\u015ftan gelme bir g\u00fcvenirlili\u011fe (d\u00fcr\u00fcstl\u00fc\u011fe) sahip olmak\u201d ko\u015fulu, buna uymayan ba\u015fvuru sahibinin, e\u011fitime \/ staja kabul edilmeyece\u011fini ortaya koymu\u015ftur.<\/p><p>Bu konuda \u015f\u00f6yle bir \u00f6rnek de verilebilir: Nas\u0131l ki, bir Hava Yolu \u015eirketinde, i\u015fe al\u0131nmadan, her isteyen, \u201cpilotluk\u201d i\u00e7in ya da bir Hava Alan\u0131 Trafik Kontrol Merkezinde \u201ctrafik operat\u00f6rl\u00fc\u011f\u00fc\u201d i\u00e7in e\u011fitim g\u00f6remez, staj yapamaz ise bu durum, k\u0131lavuzluk hizmetleri i\u00e7in de ge\u00e7erlidir.<\/p><p>Bir ba\u015fka \u00f6rnek de, \u015fu anda TD\u0130\u2019nin hizmet verdi\u011fi Bo\u011fazlar i\u00e7in verilebilir. \u00d6rne\u011fin, \u201cTaslak Y\u00f6netmelik uygulan\u0131rsa: \u0130stanbul Bo\u011faz\u0131\u2019nda staj yapmak isteyenler, 6\u2019\u0131nc\u0131 maddenin a, b, c, \u00e7, d ve f bentlerindeki ko\u015fullar\u0131 yerine getirdikten sonra, liman ba\u015fkanl\u0131\u011f\u0131na ba\u015fvurarak, K\u0131lavuz Kaptanl\u0131k Temel E\u011fitimi\u2019ni de tamamlay\u0131p, TD\u0130\u2019ye<br \/>G\u00f6revba\u015f\u0131 E\u011fitimi i\u00e7in ba\u015fvurup \u201cBeni i\u015fe al, G\u00f6revba\u015f\u0131 E\u011fitimi yapaca\u011f\u0131m\u201d m\u0131 diyecek?<\/p><p>Bir di\u011fer konu da \u015fudur, taslak y\u00f6netmelik bu \u015fekilde \u00e7\u0131karsa, \u201cK\u0131lavuz Kaptanl\u0131k Temel E\u011fitimi\u201d muhtemelen \u00fccretli olaca\u011f\u0131ndan, yetkili K\u0131lavuzluk Te\u015fkilat\u0131 taraf\u0131ndan i\u015fe al\u0131nmayan bir aday bu e\u011fitimin \u00fccretini kendisi kar\u015f\u0131lamak zorunda kalacakt\u0131r. Ancak daha sonra, Madde 8\u2019e g\u00f6re G\u00f6revba\u015f\u0131 E\u011fitimini yapmas\u0131 i\u00e7in yetkili K\u0131lavuzluk Te\u015fkilat\u0131 taraf\u0131ndan istihdam edilmesi \/ i\u015fe al\u0131nmas\u0131 gerekmektedir. Fakat yetkili K\u0131lavuzluk Te\u015fkilat\u0131, ihtiyac\u0131 olmad\u0131\u011f\u0131ndan ya da o ki\u015fiyi kendisi i\u00e7in uygun bulmad\u0131\u011f\u0131ndan (ki yukar\u0131da K\u0131lavuzluk Te\u015fkilat\u0131n\u0131n se\u00e7me hakk\u0131n\u0131 a\u00e7\u0131klad\u0131k) i\u015fe almaz ise o aday\u0131n durumu ne olacakt\u0131r?<\/p><p>B\u00fct\u00fcn bu nedenlerden \u00f6t\u00fcr\u00fc, Madde 7\u2019nin (1) bendine, yukar\u0131da \u00f6nerdi\u011fimiz \u015fekilde, \u201caday\u0131n yetkili K\u0131lavuzluk Te\u015fkilat\u0131\u2019nca istihdam edilmesi\u201d \u015fart\u0131 da eklenmelidir.<\/p><p>* Madde 8\u2019in (2-c) bendinde yer alan \u201calt\u0131 ay\u201dlar\u0131n \u201cd\u00f6rt ay\u201da ve \u201cd\u00f6rt ay\u201d\u0131n da \u201c\u00fc\u00e7 ay\u201da indirilmesi ile yine ayn\u0131 maddenin (5) bendinde yer alan \u201coniki ay\u201d\u0131n \u201cdokuz ay\u201da indirilmesi,<br \/>yerinde olacakt\u0131r.<\/p><p><strong>De\u011fi\u015fiklik Gerek\u00e7esi:<\/strong>\u00a0Adaylar\u0131n giri\u015f \u015fartlar\u0131 olduk\u00e7a y\u00fcksek tutulmu\u015ftur. Bu \u015fartlara sahip adaylar i\u00e7in taslak Y\u00f6netmelikte \u00f6nerilen s\u00fcrelerin fazla uzun oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyorum.<\/p><p>* Madde 9\u2032 (3)\u2019de say\u0131lan s\u0131nav heyeti \u201ctoplam be\u015f ki\u015fiden olu\u015fur\u201d denilmesine kar\u015f\u0131n, say\u0131lanlar\u0131n toplam\u0131 \u201cd\u00f6rt\u201d etmektedir. Heyete bir ki\u015fi daha eklenmesi gerekmektedir.<\/p><p>* Madde 12\u2019de yer alan \u201ck\u0131demli k\u0131lavuz kaptan yeterli\u011fine y\u00fckselme\u201d \u015fart\u0131 \u201cd\u00f6rt\u201d y\u0131ldan \u201ciki\u201d y\u0131la indirilmelidir.<br \/>De\u011fi\u015fiklik Gerek\u00e7esi: Belirlenen \u015fartlara sahip ki\u015filerin k\u0131demli k\u0131lavuz kaptanl\u0131\u011fa y\u00fckselme s\u00fcresi olarak d\u00f6rt y\u0131l \u00e7ok uzundur. Ayr\u0131ca, uygulamada \u201cd\u00f6rt\u201d y\u0131l, k\u0131demli k\u0131lavuz kaptan eksikli\u011fine neden olur ve hizmetlerin y\u00fcr\u00fct\u00fclmesinde aksama ve gecikmelere sebep olabilir.<\/p><p>Madde 12\u2019de yer alan: \u201c. . . ,idarece yetkilendirilmi\u015f e\u011fitim vermeye yetkili bir kurumdan k\u0131lavuz kaptanl\u0131k y\u00fckselme e\u011fitimi almas\u0131. . .\u201d c\u00fcmlesi \u00e7\u0131kart\u0131lmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc, (a) Bir k\u0131lavuz kaptan\u0131n k\u0131demli say\u0131lmas\u0131n\u0131n gerek\u00e7esi, \u201ctecr\u00fcbe\u201d kazanm\u0131\u015f olmas\u0131d\u0131r. Tecr\u00fcbe ise s\u0131navla kazan\u0131lamaz. (b) K\u0131lavuz kaptanlar zaten Madde 11\u2019e g\u00f6re d\u00fczenli e\u011fitim g\u00f6rmektedir. K\u0131demli\u2019li\u011fe y\u00fckselmede bir ek e\u011fitime gerek bulunmamaktad\u0131r.<\/p><p>* Madde 14\u2019\u00fcn (2) bendinde yer alan:<\/p><p>\u2013 \u201cmoment\u201d kelimesinin \u201cmomentum\u201d olmas\u0131 gerekti\u011fini d\u00fc\u015f\u00fcn\u00fcyorum.<\/p><p>\u2013 \u201cdevir dairesi\u201d tan\u0131m\u0131n\u0131n \u201cd\u00f6nme \u00e7emberi\u201d olarak de\u011fi\u015ftirilmesi gerekiyor (Zaten Madde 16\u2019n\u0131n (a-2)\u2019sinde de \u201cd\u00f6nme \u00e7emberi\u201d olarak yaz\u0131lm\u0131\u015f ki do\u011frusu budur). \u201cDevir dairesi\u201d hem eski kelimelerden olu\u015fuyor, hem de \u201cdaire\u201dnin tan\u0131m\u0131 \u201cBir \u00e7emberin i\u00e7inde kalan d\u00fczlem par\u00e7as\u0131\u201d oldu\u011fundan, ifade yanl\u0131\u015f oluyor. \u00c7\u00fcnk\u00fc bizim anlatmak istedi\u011fimiz, geminin d\u00f6nerken su \u00fcst\u00fcnde \u00e7izdi\u011fi \u201c\u00e7ember\u201d olup, d\u00fczlemle ilgili de\u011filiz.<\/p><p>\u2013 \u201cba\u015f ve k\u0131\u00e7 manevra pervaneleri\u201d tan\u0131m\u0131 da do\u011fru olmamaktad\u0131r.
