Biz bunlardan yaln\u0131zca \u0130zmit ve \u0130skenderun Limanlar\u0131nda \u201ck\u0131lavuzluk ve r\u00f6morkaj hizmeti\u201d veriyoruz. T\u00fcrkiye\u2019nin t\u00fcm limanlar\u0131nda ya da denizlerinde hizmet vermedi\u011fimize g\u00f6re T\u00fcrkiye\u2019nin denizlerinde \u201cmonopol\u201d olmad\u0131\u011f\u0131m\u0131z, olamayaca\u011f\u0131m\u0131z \u00e7ok a\u00e7\u0131k de\u011fil mi ?<br \/><strong>b)<\/strong>\u00a0T\u00fcrkiye\u2019deki b\u00fct\u00fcn limanlarda, y\u00fcr\u00fcrl\u00fckteki mevzuat gere\u011fi \u201cyaln\u0131zca bir tane k\u0131lavuzluk ve r\u00f6morkaj Te\u015fkilat\u0131\u201d hizmet vermektedir(Ek 1 ve2). Bir ba\u015fka deyi\u015fle, y\u00fcr\u00fcrl\u00fckteki mevzuata g\u00f6re, Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 her bir limanda \u201cyaln\u0131zca bir tane k\u0131lavuzluk ve r\u00f6morkaj te\u015fkilat\u0131na\u201d izin vermi\u015ftir. Buna g\u00f6re, \u0130zmit ve \u0130skenderun Limanlar\u0131nda da, T\u00fcrkiye\u2019deki b\u00fct\u00fcn di\u011fer limanlarda oldu\u011fu gibi, bir tane k\u0131lavuzluk ve r\u00f6morkaj te\u015fkilat\u0131 hizmet vermektedir.<br \/><strong>c)<\/strong>\u00a0Bu durum, ba\u015fta \u201cg\u00fcvenlik\u201d nedeniyle olmak \u00fczere, \u201ck\u0131lavuzluk hizmetlerinde\u201d d\u00fcnyan\u0131n her yerinde ayn\u0131d\u0131r. Yaln\u0131zca d\u00fcnyan\u0131n \u201c\u00e7ok b\u00fcy\u00fck\u201d birka\u00e7 liman\u0131nda (k\u0131lavuzluk hizmetleri yine tek) fakat r\u00f6morkaj hizmetleri, birden fazla \u015firket taraf\u0131ndan verilebilmektedir. Bu b\u00fcy\u00fck limanlar ise T\u00fcrkiye\u2019deki en b\u00fcy\u00fck limandan en az on misli daha y\u00fcksek kapasiteye sahiptir ve T\u00fcrkiye\u2019de bu b\u00fcy\u00fckl\u00fckte liman yoktur.<br \/><strong>d)<\/strong>\u00a0\u00d6te yandan bilindi\u011fi \u00fczere \u201cmonopol\u201d olman\u0131n iki temel \u015fart\u0131 vard\u0131r. Bunlardan birincisi \u201cpiyasaya tek ba\u015f\u0131na hakim olmak\u201d, ikincisi ise sunulan mal\u0131n ya da hizmetin \u201cfiyat\u0131n\u0131\u201d da belirlemektir.<br \/><strong>e)<\/strong>\u00a0Konumuzda \u00fclke \u00e7ap\u0131nda piyasaya tek ba\u015f\u0131na hakim olan hi\u00e7bir \u015firket yoktur. D\u00fcnyadaki denizcilik uygulamalar\u0131na paralel olarak her limanda bir \u201cTe\u015fkilat\u201d g\u00f6rev yapmaktad\u0131r ki bu da i\u015fin \u00f6zelli\u011finden kaynaklanmaktad\u0131r. Bu husus size EK\u2019lerde g\u00f6nderdi\u011fimiz \u201cDan\u0131\u015ftay\u201d ve \u201cRekabet Kurumu\u201d kararlar\u0131nda da a\u00e7\u0131k\u00e7a belgelenmi\u015ftir.<br \/><strong>f)<\/strong>\u00a0Uygulad\u0131\u011f\u0131m\u0131z fiyatlar ise Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 taraf\u0131ndan belirlenmekte oldu\u011fundan ve fiyatlar\u0131 kendimiz belirlemedi\u011fimizden, \u201cmonopol\u201d olman\u0131n ikinci temel \u015fart\u0131 da yoktur.<br \/><strong>* * *<\/strong><\/p><p><strong>2)<\/strong>\u00a0\u0130zmit K\u00f6rfezi\u2019nde k\u0131lavuzluk ve r\u00f6morkaj hizmetlerini TD\u0130\u2019nin verdi\u011fi y\u0131llarda, gerekli personel yan\u0131nda, r\u00f6mork\u00f6r, pilot motoru ve palamar motoru eksikli\u011fi ile ara\u00e7 gere\u00e7lerin eskili\u011fi ve g\u00fc\u00e7s\u00fczl\u00fc\u011f\u00fc nedeniyle gemilere gere\u011fince hizmet verilemiyordu. Bu y\u00fczden T\u00fcrkiye, bekleyen gemilere y\u0131lda milyonlarca dolar \u201cdemoraj\u201d \u00fccreti \u00f6d\u00fcyordu. Zaten bu nedenle 1995 y\u0131l\u0131nda Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131 harekete ge\u00e7ti ve \u00f6zel \u015firketlere \u00e7al\u0131\u015fma imkan\u0131 veren mevzuat de\u011fi\u015fikli\u011fi yapt\u0131. \u00d6zel \u015firketlere ise \u201ck\u0131lavuzluk ve r\u00f6morkaj hizmetlerini yapma izni\u201d bedava verilmedi. Bu izin kar\u015f\u0131l\u0131\u011f\u0131nda \u00f6zel \u015firketler, her ay \u201ccirolar\u0131\u201d \u00fczerinden devlete % 6,5 pay \u00f6d\u00fcyorlar. Buna g\u00f6re \u00f6rne\u011fin \u0130zmit K\u00f6rfezi\u2019nde TD\u0130 hizmet vermekteyken, tek kuru\u015f elde etmeyen devletimiz, \u015fimdi bizden her ay ciroya g\u00f6re pe\u015fin olarak % 6,5 pay al\u0131yor. Ayr\u0131ca, yar\u0131 kamusal \u00f6zelli\u011finden \u00f6t\u00fcr\u00fc, d\u00fcnyan\u0131n hi\u00e7bir yerinde, bu izinler ihale ile a\u00e7\u0131k artt\u0131rmaya \u00e7\u0131kar\u0131lan izinlerden de\u011fildir (Ek\u2019deki Dan\u0131\u015ftay ve Rekabet Kurumu Kararlar\u0131).<br \/><strong>* * *<\/strong><\/p><p><strong>3)<\/strong>\u00a0Say\u0131n Mahmut \u00d6v\u00fcr, yaz\u0131n\u0131zdan sanki, \u201c\u0130zmit K\u00f6rfezi\u2019nde 100 milyon dolarl\u0131k bir hizmet sekt\u00f6r\u00fc varm\u0131\u015f (ki bu t\u00fcm T\u00fcrkiye\u2019nin toplam\u0131d\u0131r ve bunun yar\u0131s\u0131 da \u0130stanbul ve \u00c7anakkale Bo\u011fazlar\u0131 cirosudur) ve TD\u0130 de 1997 y\u0131l\u0131nda bu i\u015fi yapmaktan nedeni anla\u015f\u0131lamayan bir bi\u00e7imde \u00e7ekiliverdi\u201d anlam\u0131 \u00e7\u0131k\u0131yor. Oysa, yukar\u0131da da anlatt\u0131\u011f\u0131m\u0131z \u00fczere TD\u0130 an\u0131lan hizmetleri zaten veremiyordu. \u00d6zel \u015firket olarak biz modern ve g\u00fc\u00e7l\u00fc r\u00f6mork\u00f6rler ve ara\u00e7 gere\u00e7ler ile yeterlikli personelle hizmet vermeye ba\u015flay\u0131nca, y\u0131llard\u0131r TD\u0130\u2019nin hizmetlerinden \u015fikayet eden ve \u00f6zel \u015firketlerin gelmesini sa\u011flayan acenteler, armat\u00f6rler, liman ve y\u00fck sahipleri hizmetlerimizden \u00e7ok memnun oldular ve b\u00fct\u00fcn i\u015fleri biz yapmaya ba\u015flad\u0131k. Daha \u00f6nce ya\u015fanan b\u00fct\u00fcn beklemeler kalkt\u0131, T\u00fcrkiye yabanc\u0131lara \u00f6demek zorunda kald\u0131\u011f\u0131 milyonarca dolar bekleme paras\u0131 \u00f6demekten kurtuldu. Biz, gece g\u00fcnd\u00fcz, f\u0131rt\u0131na demeden, hizmetleri d\u00fcnya standartlar\u0131nda m\u00fckemmel vermeye ba\u015flad\u0131k. Bunun sonucunda TD\u0130 K\u00f6rfez\u2019de i\u015f alamaz duruma geldi, zarar etmeye ba\u015flad\u0131 ve bunun sonucunda K\u00f6rfez\u2019den \u00e7ekildi.<br \/><strong>* * *<\/strong><\/p><p><strong>4)<\/strong>\u00a0\u201c28.Ocak.1998\u2019de Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131\u2019n\u0131n \u00e7\u0131kartt\u0131\u011f\u0131 y\u00f6netmelik konsorsiyuma tam bir tekel yetkisi verdi\u201d diyorsunuz, daha do\u011frusu size \u00f6yle s\u00f6yledikleri i\u00e7in \u00f6yle yazm\u0131\u015fs\u0131n\u0131z. Ancak yukar\u0131da da anlatt\u0131\u011f\u0131m\u0131z \u00fczere, y\u00f6netmelik h\u00fck\u00fcmleri d\u00fcnyadaki uygulamalara paraleldir. Bu y\u00f6netmelikle bir tekel yarat\u0131lmad\u0131\u011f\u0131 da, Dan\u0131\u015ftay ve Rekabet Kurumu kararlar\u0131yla belgelenmi\u015ftir (Ek.3,4,5,6 ve 7). \u00dcstelik, Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131, \u201cK\u0131lavuzluk Ve R\u00f6morkaj Hizmetleri Te\u015fkilatlar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d uyar\u0131nca yaln\u0131z bizim Konsorsiyumumuza de\u011fil, T\u00fcrkiye Limanlar\u0131nda hizmet veren b\u00fct\u00fcn \u015firketlere ayn\u0131 yetkiyi verdi. Bu arada \u015funu da belirtelim ki, 1997 y\u0131l\u0131nda \u015fayet TD\u0130 \u0130zmit K\u00f6rfezi\u2019nden \u00e7ekilmemi\u015f olsayd\u0131, 1998 y\u0131l\u0131nda \u00e7\u0131kan \u201cY\u00f6netmelik\u201d uyar\u0131nca, M\u00fcste\u015farl\u0131k yine \u201cyaln\u0131zca bir te\u015fkilata\u201d izin vermek zorundayd\u0131.B\u00f6yle bir durumda ise zaten \u015fikayetler nedeniyle mevzuat de\u011fi\u015fikli\u011fine neden olan TD\u0130\u2019nin izin alamayaca\u011f\u0131 da \u00e7ok a\u00e7\u0131k\u00e7a ortadad\u0131r. Dolay\u0131s\u0131yla, \u201cTD\u0130 \u00e7ekilmeseydi rekabet olacakt\u0131, TD\u0130 \u00e7ekildi\u011fi i\u00e7in rekabet olam\u0131yor\u201d iddialar\u0131 ge\u00e7ersizdir.<br \/><strong>* * *<\/strong><\/p><p><strong>5)<\/strong>\u00a02003 y\u0131l\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren \u201cLiman Hizmet Tarifeleri\u201d ile Konsorsiyumun sars\u0131ld\u0131\u011f\u0131 ise do\u011fru olup, bu sars\u0131lma eski Deka\u015f y\u00f6netimini d\u0131\u015far\u0131dan etkileyen ve yanl\u0131\u015f davranmas\u0131n\u0131 sa\u011flayan, konsorsiyumu par\u00e7alay\u0131p iznini iptal ettirmek isteyen ve y\u0131llard\u0131r u\u011fra\u015f\u0131p alamad\u0131klar\u0131 \u201cizni\u201d bu yolla alarak menfaat sa\u011flamaya \u00e7al\u0131\u015fan ve \u015fu anda ellerindeki havadan para kazanma olanaklar\u0131n\u0131 kaybeden baz\u0131 \u00e7evrelerin i\u015fidir.<br \/><strong>* * *<\/strong><\/p><p><strong>6)<\/strong>\u00a0D\u00fcnyan\u0131n hi\u00e7bir yerinde armat\u00f6r\u00fc temsil eden ve g\u00f6revi onun menfaatlerini korumak olan acentelerin, armat\u00f6re y\u00f6nelik hizmet vermesine izin verilmemektedir. Asl\u0131nda bizde de, 31.10.2005 tarihli Resmi Gazete\u2019de yay\u0131mlanan \u201cGemi Acenteleri Hakk\u0131nda Y\u00f6netmelik\u201din madde 12 (e) bendi de buna izin vermemektedir (Ek.8) Buna kar\u015f\u0131l\u0131k bizde, acente ve armat\u00f6rlerin kurdu\u011fu ve y\u0131llard\u0131r d\u00fcnyadaki uygulamalara ayk\u0131r\u0131 olarak bu alanda hizmet vermek isteyen bir \u015firket, Konsorsiyumun iki orta\u011f\u0131n\u0131 birbirine d\u00fc\u015f\u00fcrerek, akla, mant\u0131\u011fa, d\u00fcnyadaki uygulamalara ters bi\u00e7imde \u201crekabet\u201d ortaya \u00e7\u0131kmas\u0131n\u0131 sa\u011flad\u0131. Tek bir \u201cTe\u015fkilat\u201d olarak izin alan bir konsorsiyumun iki orta\u011f\u0131n\u0131n \/ kanad\u0131n\u0131n birbiriyle rekabet etti\u011fi d\u00fcnyan\u0131n neresinde g\u00f6r\u00fclm\u00fc\u015f?<br \/><strong>* * *<\/strong><\/p><p><strong>7)<\/strong>\u00a0T\u00fcrkiye\u2019de hi\u00e7bir limanda rekabet ya\u015fanmazken, \u0130zmit ve \u0130skenderun K\u00f6rfezlerinde kendi menfaatleri i\u00e7in suni rekabet ortaya \u00e7\u0131kartanlar, bundan yararlanarak hem d\u00fcnyadaki uygulamalara hem de bizdeki \u201cGemi Acenteleri Hakk\u0131nda Y\u00f6netmeli\u011fi\u201de ayk\u0131r\u0131 olarak kurduklar\u0131 \u015firketi K\u00f6rfeze sokup bo\u015fta bulunan r\u00f6mork\u00f6rlerine i\u015f bulup para kazand\u0131lar, hem Deka\u015f\u2019\u0131n elindeki r\u00f6mork\u00f6rleri \u00e7ok ucuza ve \u00e7ok uzun vadeyle sat\u0131n ald\u0131lar (bu konuda dava a\u00e7t\u0131k), hem de fiyatlar\u0131 a\u015f\u0131r\u0131 k\u0131rd\u0131r\u0131p, indirim sa\u011flad\u0131lar ama bu indirimlerin \u00e7o\u011fu as\u0131l sahibine yans\u0131may\u0131p, kesilen iade \/ komisyon faturalar\u0131yla baz\u0131lar\u0131n\u0131n ceplerine girdi. \u015eimdi bak\u0131yoruz bunlar bizi, size ve ba\u015fka yerlere \u015fikayet edenlerin ba\u015f\u0131nda geliyorlar.<br \/><strong>* * *<\/strong><\/p><p><strong>8)<\/strong>\u00a0Baz\u0131 acente ve armat\u00f6rler indirimlerden o kadar b\u00fcy\u00fck kazan\u00e7lar elde ettiler ve a\u015f\u0131r\u0131ya ka\u00e7t\u0131lar ki, sonunda Deka\u015f 2005 y\u0131l\u0131n\u0131 3 trilyon TL zararla kapat\u0131p iflas\u0131n e\u015fi\u011fine geldi. \u015eirketlerinin batmakta ya da bat\u0131r\u0131lmakta oldu\u011funu g\u00f6ren Deka\u015f ortaklar\u0131 31.Mart.2006\u2019da yap\u0131lan Genel Kurulda izledi\u011fi yanl\u0131\u015f politikalarla bat\u0131\u015f\u0131n e\u015fi\u011fine getiren y\u00f6netimi de\u011fi\u015ftirdi.<br \/><strong>* * *<\/strong><\/p><p><strong>9)<\/strong>\u00a0Say\u0131n Mahmut \u00d6v\u00fcr, \u015fimdi size soruyoruz: \u201cDeka\u015f ortaklar\u0131n\u0131n \u015firketlerini bat\u0131ran bir y\u00f6netimi de\u011fi\u015ftirmesinden daha do\u011fal ne olabilir?\u201d. \u201cBu \u015fartlar alt\u0131nda, se\u00e7imi kazanmak i\u00e7in, \u015firketi kurtarmaya aday olanlar\u0131n parayla ortak ba\u011flamas\u0131na gerek var m\u0131?\u201d. \u201cDi\u011fer yandan, indirimlerden, rekabetten b\u00fcy\u00fck kazan\u00e7 sa\u011flayanlar\u0131n, kendilerine bu imkanlar\u0131 sa\u011flayan \u015firketin ba\u015f\u0131ndaki y\u00f6netimin biraz daha ba\u015fta kalabilmesini sa\u011flamak i\u00e7in parayla ortak ba\u011flama i\u015flerine giri\u015febilmesi akla daha mant\u0131kl\u0131 gelmiyor mu?\u201d. Eski y\u00f6netim taraf\u0131ndan, adam ka\u00e7\u0131rma da dahil baz\u0131 oyunlar oynad\u0131lar ama durum o kadar a\u00e7\u0131k\u00e7a ortadayd\u0131 ki, ba\u015faramad\u0131lar ve Deka\u015f ortaklar\u0131 \u015firketi bat\u0131ranlar\u0131 g\u00f6revden uzakla\u015ft\u0131rd\u0131. \u00c7e\u015fitli yollarla ba\u015fta kalmaya \u00e7al\u0131\u015f\u0131p muvaffak olamayanlar \u015fimdi \u201cyavuz h\u0131rs\u0131z ev sahibini bast\u0131r\u0131r\u201d rollerindeler.<br \/><strong>* * *<\/strong><\/p><p><strong>10)<\/strong>\u00a0Deka\u015f y\u00f6netiminin de\u011fi\u015fmesinden sonra yeni y\u00f6netim \u015firketin bat\u0131\u015f\u0131n\u0131 \u00f6nlemek i\u00e7in, son 2 y\u0131lda baz\u0131 acente ve armat\u00f6rlerin ceplerini dolduran indirimleri kald\u0131rarak, Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131\u2019n\u0131n resmi Hizmet Tarifesi\u2019ni uygulamaya ba\u015flad\u0131. Bunun \u00fczerine, son 2 y\u0131ld\u0131r oturduklar\u0131 yerden hi\u00e7bir i\u015f yapmadan indirimler yoluyla ceplerini doldurmaya al\u0131\u015fan ve hi\u00e7 sesleri \u00e7\u0131kmayan baz\u0131 acente ve armat\u00f6rler, tatl\u0131 kazan\u00e7lar\u0131ndan olunca aya\u011fa kalkarak \u201cK\u00f6rfezde tekel olu\u015ftu\u201d, \u201cEl ele verdiler, Sekt\u00f6r\u00fcn ba\u015f\u0131na sopay\u0131 indiriyorlar\u201d diye ba\u011f\u0131rmaya ba\u015flad\u0131lar.
