Bu nedenle bu hizmetlerde, devlet a\u00e7\u0131s\u0131ndan \u00f6nemli olan, \u201cdaha y\u00fcksek k\u00fcr elde etmek\u201d amac\u0131 de\u011fil, \u201cg\u00fcvenli\u011fin daha y\u00fcksek sa\u011flanmas\u0131\u201d amac\u0131 olmal\u0131d\u0131r.<\/p><p>\u0130znin devlete en y\u00fcksek k\u00e2r\u0131 sa\u011flayana verilmesi ise ister istemez, ama\u00e7lanan g\u00fcvenli\u011fin kalitesini d\u00fc\u015f\u00fcr\u00fcr.<\/p><p>\u00d6te yandan, devlet taraf\u0131ndan izin verilen k\u0131lavuzluk ve r\u00f6mork\u00f6rc\u00fcl\u00fck te\u015fkilatlar\u0131, zaten, hem k\u00e2r elde ettiklerinde, devlete her ticari kurulu\u015fun \u00f6dedi\u011fi normal vergisini vermekte, hem de k\u00e2r elde etsinler veya etmesinler, br\u00fct has\u0131latlar\u0131 \u00fczerinden her ay sonu, Bakanlar Kurulu\u2019nca tespit edilen oranda bir \u201cPay\u201d da \u00f6demektedirler. Bu nedenle, gemi kaptan\u0131 niteli\u011findeki bir ki\u015fi belirli bir alan i\u00e7in e\u011fitilip, s\u0131navdan ge\u00e7tikten sonra, e\u011fitim g\u00f6r\u00fcp s\u0131nav verdi\u011fi \u201co belirli alan i\u00e7in\u201d k\u0131lavuz kaptan yeterlik belgesi al\u0131r ve ald\u0131\u011f\u0131 yeterlik belgesi ile yaln\u0131zca \u201co alanda\u201d k\u0131lavuz kaptanl\u0131k yapabilir, ba\u015fka bir alanda yapamaz. \u015eayet ba\u015fka bir alanda da, yapmak isterse \u201co alan i\u00e7in de\u201d ayr\u0131ca e\u011fitim g\u00f6r\u00fcp, s\u0131nav verip, yeterlik belgesi almas\u0131 \u015fartt\u0131r.<\/p><p>\u00d6ncelikle bu nedenle, k\u0131lavuzluk te\u015fkilatlan da, belirli bir k\u0131lavuzluk b\u00f6lgesi s\u0131n\u0131rlar\u0131 i\u00e7inde hizmet vermek \u00fczere yetkilendirilirler. Bir ba\u015fka a\u00e7\u0131dan s\u00f6ylersek, s\u0131n\u0131rlar\u0131 belirlenmi\u015f bir alan i\u00e7in yeterlik belgesi alan k\u0131lavuz kaptanlar \u201co b\u00f6lgede\u201d, hizmet veren bir k\u0131lavuzluk te\u015fkilat\u0131n\u0131 olu\u015ftururlar.<\/p><p>Bunun neden b\u00f6yle olmas\u0131 gerekti\u011fi, Dan\u0131\u015ftay Onuncu Dairesinin 2000\u2019e 5276 numaral\u0131 karar\u0131nda, \u015fu \u015fekilde, \u00e7ok g\u00fczel belirtilmi\u015ftir:<\/p><p>\u201cK\u0131lavuzluk ve r\u00f6morkaj hizmetleri, seyir g\u00fcvenli\u011fi kapsam\u0131nda verilen hizmetler olup, denizde seyir, can, mal ve \u00e7evre g\u00fcvenli\u011finin sa\u011flanmas\u0131na y\u00f6nelik \u00f6zelli\u011fi dolay\u0131s\u0131yla, s\u0131n\u0131rlar\u0131 belli bir b\u00f6lgede bu hizmetlerin, merkezi bir organizasyon taraf\u0131ndan, karga\u015faya ve kaosa sebep olmadan, bir d\u00fczen i\u00e7inde verilmesi gerekli bulunmaktad\u0131r. Denizcilik hizmetlerinin uluslararas\u0131 niteli\u011fi ve d\u00fcnyadaki uygulamalar\u0131 da dikkate al\u0131narak, uygun yat\u0131r\u0131mlar\u0131n yap\u0131lmas\u0131, kaynaklar\u0131n verimli kullan\u0131lmas\u0131 ve kaliteli hizmet verilmesi amac\u0131yla bir k\u0131lavuzluk ve r\u00f6morkaj te\u015fkilat\u0131 b\u00f6lgesi s\u0131n\u0131rlar\u0131 i\u00e7inde, yaln\u0131z bir k\u0131lavuzluk ve r\u00f6morkaj te\u015fkilat\u0131na izin verilmi\u015ftir\u2026 Bu itibarla, tekel meydana gelece\u011fi iddias\u0131 da yerinde bulunmamaktad\u0131r.\u201d<\/p><p>K\u0131saca, b\u00fct\u00fcn d\u00fcnyada, bu hizmetlerin temeli olan g\u00fcvenli\u011fin sa\u011flanmas\u0131 i\u00e7in, \u201cs\u0131n\u0131rlar\u0131 belirlenmi\u015f bir b\u00f6lgede\u201d, hem belirli bir alanda uzmanla\u015f\u0131lmas\u0131, hem de hizmetlerin merkezi bir organizasyon taraf\u0131ndan d\u00fczenlenerek kar\u0131\u015f\u0131kl\u0131\u011fa neden olmadan bir d\u00fczen i\u00e7inde verilebilmesi a\u00e7\u0131s\u0131ndan, yaln\u0131zca \u201cbir k\u0131lavuzluk te\u015fkilat\u0131 hizmet verir\u201d.<\/p><p>\u00dclkemizde ve d\u00fcnyadaki, bir di\u011fer uygulama da, \u201cher bir liman b\u00f6lgesinin, s\u0131n\u0131rlan belirli bir alan\u201d olarak kabul edilmesidir. Yine bunlara paralel bi\u00e7imde, genel bir kural olarak \u201cHer liman s\u0131n\u0131rlar\u0131 bir k\u0131lavuzluk b\u00f6lgesidir\u201d.<\/p><p>Bu temel kurallar a\u00e7\u0131lar\u0131ndan bakt\u0131\u011f\u0131m\u0131zda, taslak Te\u015fkilat Y\u00f6netmeli\u011fi\u2019nde, \u201cBir b\u00f6lgede bir k\u0131lavuzluk te\u015fkilat hizmet verir\u201d, dolay\u0131s\u0131yla, \u201cHer k\u0131lavuzluk te\u015fkilat\u0131n\u0131n s\u0131n\u0131r\u0131 bir di\u011fer k\u0131lavuzluk te\u015fkilat\u0131n\u0131n s\u0131n\u0131r\u0131nda biter\u201d ile \u201cHer bir liman ayr\u0131 bir k\u0131lavuzluk b\u00f6lgesidir\u201d \u015feklindeki genel kurallarla \u00e7eli\u015fen maddeler oldu\u011funu g\u00f6r\u00fcyoruz.<\/p><p>\u00d6rne\u011fin, 4\u2019\u00fcnc\u00fc Maddenin (d) bendinde \u201cK\u0131lavuzluk ve\/veya R\u00f6mork\u00f6rc\u00fcl\u00fck Te\u015fkilat\u0131 Hizmet B\u00f6lgesi\u201d tan\u0131m\u0131n\u0131n sonunda \u201c\u2026k\u0131lavuz kaptan alman\u0131n zorunlu oldu\u011fu bir liman b\u00f6lgesinin s\u0131n\u0131rlar\u0131 i\u00e7inde kalan bir veya birden fazla deniz alan\u0131n\u0131\u201d denilerek, bir liman b\u00f6lgesinin s\u0131n\u0131rlar\u0131 i\u00e7inde birden fazla te\u015fkilat hizmet b\u00f6lgesi olabilece\u011fi kabul edilmi\u015ftir ki, bu d\u00fcnyadaki genel uygulamalara ayk\u0131r\u0131d\u0131r.<\/p><p>Ayr\u0131ca, Taslak Y\u00f6netmeli\u011fin 26\u2019nc\u0131 Maddesinin (5)\u2019inci bendinde \u201cBir k\u0131lavuzluk ve\/veya r\u00f6mork\u00f6rc\u00fcl\u00fck te\u015fkilat\u0131n\u0131n yetkilendirildi\u011fi hizmet b\u00f6lgesindeki r\u0131ht\u0131m ve iskelelere, a\u00e7\u0131k deniz k\u0131y\u0131 tesislerine, demir yerleri veya \u015famand\u0131ralara ula\u015fmak i\u00e7in k\u0131lavuz alma\/\u00e7\u0131kartma yerlerinden itibaren seyredilmesi zorunlu olan deniz alan\u0131, m\u00fcnhas\u0131ran a\u00e7\u0131k deniz k\u0131lavuzluk alan\u0131 olarak ilan edilmemi\u015f olan s\u0131n\u0131rda\u015f ba\u015fka bir k\u0131lavuzluk ve \/veya r\u00f6mork\u00f6rc\u00fcl\u00fck te\u015fkilat\u0131 hizmet b\u00f6lgesinin i\u00e7inde kal\u0131yor ise, s\u00f6z konusu te\u015fkilat bu deniz alan\u0131nda k\u0131lavuzlu ve r\u00f6mork\u00f6rl\u00fc ge\u00e7i\u015f hakk\u0131na sahiptir.\u201d denilmektedir.<\/p><p>Bu kural da, yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z k\u0131lavuzluk hizmetlerinin temellerine ve d\u00fcnyadaki uygulamalara tamamen ayk\u0131r\u0131d\u0131r. Yine bu kural, Dan\u0131\u015ftay Onuncu Dairesinin karar\u0131nda ifadesini bulan \u201cs\u0131n\u0131rlan belli bir b\u00f6lgede bu hizmetlerin merkezi bir organizasyon taraf\u0131ndan karga\u015faya ve kaosa sebep olmadan, bir d\u00fczen i\u00e7inde verilmesi gerekmektedir\u201d ifadesine de t\u00fcm\u00fcyle terstir.<\/p><p>Taslak Y\u00f6netmeli\u011fin 4\u2019\u00fcnc\u00fc Maddesinin (d) bendinin, \u00dclkemizdeki Kamu Limanlar\u0131n\u0131n sahip oldu\u011fu \u201ctekel\u201d hakk\u0131n\u0131n yaratt\u0131\u011f\u0131 fiili durumun yans\u0131mas\u0131 oldu\u011funu kabul etsek bile, \u201cs\u0131n\u0131rlar\u0131 belirli bir hizmet b\u00f6lgesinde\u201d, bir birlerinin i\u00e7inden ge\u00e7erek de olsa, iki te\u015fkilat\u0131n \u00e7al\u0131\u015fmas\u0131na olanak sa\u011flayan, 26\u2019nc\u0131 Maddenin (5)\u2019inci bendi kesinlikle kabul edilemez ve mutlaka kald\u0131r\u0131lmal\u0131d\u0131r. \u00dcstelik, t\u00fcm kamu limanlar\u0131 \u00f6zelle\u015ftirilmektedir.<br \/>Bu problem, \u201cher te\u015fkilat\u0131n kendi s\u0131n\u0131rlar\u0131 i\u00e7inde \u00e7al\u0131\u015fmas\u0131\u201d ve \u201ck\u0131lavuz kaptan alma \/ \u00e7\u0131kartma yerlerinin her te\u015fkilat\u0131n s\u0131n\u0131r b\u00f6lgesinde olmas\u0131\u201d ilkeleri benimsenerek \u00e7\u00f6z\u00fclebilir ve mutlaka \u00e7\u00f6z\u00fclmelidir.<\/p><p>Bir noktay\u0131 da belirtelim ki, sebep kamu limanlar\u0131n\u0131n mevcut durumu dahi olsa, k\u0131lavuzlu\u011fun ve d\u00fcnya uygulamalar\u0131n\u0131n temellerine ayk\u0131r\u0131 kurallar konulmamal\u0131d\u0131r.
